Common use of Unlawful Use of Service Clause in Contracts

Unlawful Use of Service. Services provided by VERIZON pursuant to this Agreement shall not be used by SPRINT or its customers for any purpose in violation of law. SPRINT, and not VERIZON, shall be responsible to ensure that SPRINT and its customers’ use of services provided hereunder comply at all times with all applicable laws. VERIZON may refuse to furnish service to SPRINT or disconnect particular services provided under this Agreement to SPRINT or, as appropriate, SPRINT's customer when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) VERIZON is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by VERIZON is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to SPRINT, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to VERIZON the written finding of a court, then upon request of SPRINT and agreement to pay restoral of service charges and other applicable service charges, VERIZON shall promptly restore such service.

Unlawful Use of Service. Services provided by VERIZON GTE pursuant to this Agreement shall not be used by SPRINT RECONEX or its customers end users for any purpose in violation of law. SPRINTRECONEX, and not VERIZONGTE, shall be responsible to ensure that SPRINT RECONEX and its customersend users’ use of services provided hereunder comply at all times with all applicable laws. VERIZON GTE may refuse to furnish service to SPRINT RECONEX or disconnect particular services provided under this Agreement to SPRINT RECONEX or, as appropriate, SPRINTRECONEX's customer end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) VERIZON GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by VERIZON GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. SPRINTServiSense, and not VERIZONVerizon, shall be responsible to ensure that SPRINT ServiSense and its customers’ use of services provided hereunder comply at all times with all applicable laws. VERIZON Verizon may refuse to furnish service to SPRINT ServiSense or disconnect particular services provided under this Agreement to SPRINT ServiSense or, as appropriate, SPRINTServiSense's customer when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) VERIZON Verizon is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by VERIZON Verizon is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to SPRINTServiSense, or as ordered by the court. SPRINTFirst Choice, and not VERIZONGTE, shall be responsible to ensure that SPRINT First Choice and its customersend users’ use of services provided hereunder comply at all times with all applicable laws. VERIZON GTE may refuse to furnish service to SPRINT First Choice or disconnect particular services provided under this Agreement to SPRINT First Choice or, as appropriate, SPRINTFirst Choice's customer end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) VERIZON GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by VERIZON GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to SPRINTFirst Choice, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to VERIZON GTE the written finding of a court, then upon request of SPRINT First Choice and agreement to pay restoral of service charges and other applicable service charges, VERIZON GTE shall promptly restore such service.

SPRINTDirect Communications, and not VERIZONGTE, shall be responsible to ensure that SPRINT Direct Communications and its customers’ use of services provided hereunder comply at all times with all applicable laws. VERIZON GTE may refuse to furnish service to SPRINT Direct Communications or disconnect particular services provided under this Agreement to SPRINT Direct Communications or, as appropriate, SPRINTDirect Communications's customer when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) VERIZON GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by VERIZON GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to SPRINTDirect Communications, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to VERIZON GTE the written finding of a court, then upon request of SPRINT Direct Communications and agreement to pay restoral of service charges and other applicable service charges, VERIZON GTE shall promptly restore such service.

Unlawful Use of Service. Services provided by VERIZON FTC pursuant to this Agreement shall not be used by SPRINT FLATEL or its customers end users for any purpose in violation of law. SPRINT, and not VERIZON, FLATEL shall be responsible to ensure that SPRINT FLATEL and its customers’ end users use of services provided hereunder comply at all times with all applicable laws. VERIZON FTC may refuse to furnish service to SPRINT FLATEL or disconnect particular services provided under this Agreement to SPRINT FLATEL or, as appropriate, SPRINTFLATEL's customer end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) VERIZON FTC is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by VERIZON FTC is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to SPRINTFLATEL, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to VERIZON FTC the written finding of a court, then upon request of SPRINT FLATEL and agreement to pay restoral of service charges and other applicable service charges, VERIZON FTC shall promptly restore such service.
