Common use of Unlawful Use of Service Clause in Contracts

Unlawful Use of Service. Services provided by GTE pursuant to this Agreement shall not be used by PHNLK or its end users for any purpose in violation of law. PHNLK, and not GTE, shall be responsible to ensure that PHNLK and its end users use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to PHNLK or disconnect particular services provided under this Agreement to PHNLK or, as appropriate, PHNLK's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to PHNLK, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of PHNLK and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

PHNLKLONE STAR, and not GTE, shall be responsible to ensure that PHNLK LONE STAR and its end users users’ use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to PHNLK LONE STAR or disconnect particular services provided under this Agreement to PHNLK LONE STAR or, as appropriate, PHNLKLONE STAR's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. GTE may refuse to furnish service to PHNLK RECONEX or disconnect particular services provided under this Agreement to PHNLK RECONEX or, as appropriate, PHNLKRECONEX's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. GTE may refuse to furnish service to PHNLK NEW PHONE or disconnect particular services provided under this Agreement to PHNLK NEW PHONE or, as appropriate, PHNLKNEW PHONE's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to PHNLKNEW PHONE, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of PHNLK NEW PHONE and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

PHNLKUSTELCOM, and not GTE, shall be responsible to ensure that PHNLK USTELCOM and its end users use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to PHNLK USTELCOM or disconnect particular services provided under this Agreement to PHNLK USTELCOM or, as appropriate, PHNLKUSTELCOM's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to PHNLKUSTELCOM, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of PHNLK USTELCOM and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

Unlawful Use of Service. Services provided by GTE pursuant to this Agreement shall not be used by PHNLK EZ Talk or its end users for any purpose in violation of law. PHNLKEZ Talk, and not GTE, shall be responsible to ensure that PHNLK EZ Talk and its end users use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to PHNLK EZ Talk or disconnect particular services provided under this Agreement to PHNLK EZ Talk or, as appropriate, PHNLKEZ Talk's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to PHNLKEZ Talk, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of PHNLK EZ Talk and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

Unlawful Use of Service. Services provided by GTE pursuant to this Agreement shall not be used by PHNLK Suretel or its end users for any purpose in violation of law. PHNLKSuretel, and not GTE, shall be responsible to ensure that PHNLK Suretel and its end users users’ use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to PHNLK Suretel or disconnect particular services provided under this Agreement to PHNLK Suretel or, as appropriate, PHNLKSuretel's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to PHNLKSuretel, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of PHNLK Suretel and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.
