Common use of Unlawful Use of Service Clause in Contracts

Unlawful Use of Service. Services provided by GTE pursuant to this Agreement shall not be used by TELECONEX or its end users for any purpose in violation of law. TELECONEX, and not GTE, shall be responsible to ensure that TELECONEX and its end users use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to TELECONEX or disconnect particular services provided under this Agreement to TELECONEX or, as appropriate, TELECONEX's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to TELECONEX, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of TELECONEX and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

TELECONEXEZ-TEL, and not GTE, shall be responsible to ensure that TELECONEX EZ-TEL and its end users use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to TELECONEX EZ-TEL or disconnect particular services provided under this Agreement to TELECONEX EZ-TEL or, as appropriate, TELECONEXEZ-TEL's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to TELECONEXEZ-TEL, or as ordered by the court. TELECONEXNT, and not GTE, shall be responsible to ensure that TELECONEX NT and its end users use of services services, facilities or unbundled elements provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to TELECONEX NT or disconnect particular services services, facilities or unbundled elements provided under this Agreement to TELECONEX NT or, as appropriate, TELECONEXNT's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service service, facilities or unbundled elements is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to TELECONEXNT, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of TELECONEX NT and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GTE may refuse to furnish service to TELECONEX COMM SOUTH or disconnect particular services provided under this Agreement to TELECONEX COMM SOUTH or, as appropriate, TELECONEX's COMM SOUTH’s end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. GTE may refuse to furnish service to TELECONEX Max-Tel or disconnect particular services provided under this Agreement to TELECONEX Max-Tel or, as appropriate, TELECONEXMax-Tel's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. TELECONEXTEL - LINK, and not GTE, shall be responsible to ensure that TELECONEX TEL - LINK and its end users use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to TELECONEX TEL - LINK or disconnect particular services provided under this Agreement to TELECONEX TEL - LINK or, as appropriate, TELECONEXTEL - LINK's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to TELECONEXTEL - LINK, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of TELECONEX TEL - LINK and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

TELECONEXBuy-Tel, and not GTE, shall be responsible to ensure that TELECONEX Buy-Tel and its end users use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to TELECONEX Buy-Tel or disconnect particular services provided under this Agreement to TELECONEX Buy-Tel or, as appropriate, TELECONEXBuy-Tel's end user users when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to TELECONEXBuy-Tel, or as ordered by the court.
