Common use of UNPRICED GOODS Clause in Contracts

UNPRICED GOODS. In the event that Chemonics requests an unpriced product in the Price Schedule or an unpriced product not listed in the Price Schedule, the Supplier shall respond with a fixed unit price quotation on an all-inclusive basis, including all costs per INCOTERM, in US dollars. The Supplier shall provide the best offer price quotation which shall become the price applicable for the designated product for the Order. The Supplier’s price response will be considered certification that its quotation is equal to or less than the lower of the following: a) the Supplier’s catalog or open market price for the product, or b) the price at which the Supplier currently sells the product under comparable terms and conditions to any United States Government or United States Government funded customer.
