Common use of U.S. Government Rights Clause in Contracts

U.S. Government Rights. The Software and its documentation are “commercial computer software” and “commercial computer software documentation,” respectively, as such terms are used in FAR 12.212 and DFARS 227.7202. If the Software and its documentation are being acquired by or on behalf of the U.S. Government, then, as provided in FAR 12.212 and DFARS 227.7202-1 through 227.7202-4, as applicable, the U.S. Government’s rights in the Software and its documentation shall be as specified in this Agreement.

U.S. Government Rights. The Software and its documentation Documentation are “commercial computer software” and or “commercial computer software documentation,” respectively, as such terms are used defined in FAR 2.101 and FAR 12.212 and DFARS 227.7202they are provided only with the rights under this XXXX and with no other or additional rights under the FARs or DFARs. If Any use, modification, reproduction release, performance, display or disclosure of the Software and its documentation are being acquired Documentation by or on behalf of the U.S. Government, then, as provided in FAR 12.212 and DFARS 227.7202-1 through 227.7202-4, as applicable, the U.S. Government’s rights in the Software and its documentation Government shall be as specified solely in accordance with the terms of this Agreement.

If they are provided only with the Software rights under this Agreement and its documentation are being acquired by with no other or on behalf of additional rights under the U.S. Government, then, as provided in FAR 12.212 and DFARS 227.7202-1 through 227.7202-4, as applicable, the U.S. Government’s rights in the Software and its documentation shall be as specified in this AgreementFARs or DFARs.
