Use of Agents or Assistants. With CITY’s prior written approval, CONSULTANT may employ, engage, or retain the services of persons or entities (“Subconsultants”) that CONSULTANT may deem proper to aid or assist in the proper performance of CONSULTANT’s duties. CITY is an intended beneficiary of all work that the Subconsultants perform for purposes of establishing a duty of care between the Subconsultants and CITY. CONSULTANT is as responsible for the performance of its Subconsultants as it would be if it had rendered the Services itself. All costs of the tasks performed or the expenses incurred by the Subconsultants are chargeable directly to CONSULTANT. Nothing in this Agreement constitutes or creates a contractual relationship between CITY and anyone other than CONSULTANT.

Use of Agents or Assistants. To the extent reasonably necessary to enable the Consultant to perform the duties under this Agreement, the Consultant is authorized to engage the services of any agents or assistants that the Consultant may deem proper and further to employ, engage, or retain the services of such other persons, businesses, or corporations to aid or assist the Consultant in the proper performance of the Consultant’s duties. The Consultant shall assign only competent personnel to the performance of such duties. The Consultant shall ensure that such agents and assistants, if any, who perform services under this Agreement shall comply with the provisions of this Agreement.

Without limiting the foregoing, the parties acknowledge and agree that Bolsover Endeavours shall at all times use, and that the Company specifically requires and has bargained under the terms of this Agreement for the use of, Professional.

Concierge is authorized to engage the services of any agents, assistants, persons, corporations, or subcontractors that it determines reasonably necessary to aid or assist in the proper performance of its obligations pursuant to this Agreement.
