Common use of USE OF LEASED PREMISES AND BUILDING Clause in Contracts

USE OF LEASED PREMISES AND BUILDING. A. Tenant shall use the Leased Premises solely as a space to provide performing arts education, open only to Tenant’s members, and shall not use the Leased Premises for any other use or purpose without the prior written consent of the Landlord, which may be withheld in Landlord’s sole discretion. B. At all times Tenant shall provide supervision for its activities and use of the Leased Premises. The supervision shall at all times be by those persons with the appropriate training and professional credentials for the activity being conducted. Upon by demand by Landlord, Tenant shall confirm and certify to the Landlord that its activities comply with all applicable laws, rules, regulations, and standards governing its operation. C. Landlord warrants and represents that the Building is zoned R1, Single Family Residential District. D. Landlord warrants and represents that the property and Building is in compliance with all federal, state and local laws, ordinances and regulations, including but not limited to life safety codes. E. Tenant shall not use or occupy the Leased Premises or permit the use or occupancy of the Leased Premises for any purpose or in any manner which (1) is unlawful or in violation of any applicable legal or governmental requirement, ordinance or rule; (2) may be dangerous to persons or property; (3) may invalidate or increase the amount of premiums for any policy of insurance affecting Lakeview Recreation Center and if any additional amounts of insurance premiums are so incurred, Tenant shall pay to Landlord the additional amounts on demand; or (4) may create a nuisance, disturb any other tenant, program, or injure the reputation of the Landlord; provided, however, that Landlord agrees that Xxxxxx’s contemplated uses of the Leased Premises will not violate any provisions in this section 8.
