Common use of Use of Lender’s Name Clause in Contracts

Use of Lender’s Name. The Borrower hereby agrees that neither the Borrower nor the Servicer shall refer to or use the name "CFSC Capital Corp. XXXIV," "Xxxxxxx Financial Services Corporation," "CFSC", "Xxxxxxx, Xxxxxxxxxxxx" or "Xxxxxxx", or any such name in any manner in any collection or enforcement activities with respect to any Asset or in any advertising, printed material, electronic medium or other medium, without first obtaining the Lender's prior written consent. The Lender shall have no obligation to give any such written consent and may withhold the same in its sole and absolute discretion.

The Borrower hereby agrees that that, except as may be required by applicable law or legal proceedings, neither the Borrower nor the Servicer shall refer to or use the name "CFSC Capital Corp. XXXIV," "Xxxxxxx Financial Services Corporation," "CFSC", "Xxxxxxx, XxxxxxxxxxxxVIII" or "Xxxxxxx"any of the other names referred to in EXHIBIT F, or any such name in any manner in any collection or enforcement activities with respect to any Asset or in any advertising, printed material, electronic medium or other medium, without first obtaining the Lender's prior written consent. The Lender shall have no obligation to give any such written consent and may withhold the same in its sole and absolute discretion.
