Common use of Use of Payments Clause in Contracts

Use of Payments. The Contractor shall use all sums paid to it pursuant to this Contract for the performance of the Work in accordance with the Contract Documents. Upon the request of the Owner or Engineer, the Contractor shall furnish satisfactory proof of payment, including, but not limited to, partial release of liens and the Business Diversity Monthly Compliance Report, as to the disposition of any monies paid to the Contractor by the Owner.

Use of Payments. The Contractor shall use all sums paid to it pursuant to this Contract Agreement for the performance of the Work in accordance with the Contract Documents. Upon the request of the Owner or EngineerOwner, the Contractor shall furnish satisfactory proof of payment, including, but not limited to, partial release of liens and the Business Diversity Monthly Compliance Report, as to the disposition of any monies paid to the Contractor by Owner; provided that no provision shall be construed to require Owner to see to the Ownerproper distribution, disposition or application of the monies paid to Contractor.
