Common use of Use of Subcontractors and Agents Clause in Contracts

Use of Subcontractors and Agents. Business Associate shall ensure that: (i) all of its Subcontractors and agents shall implement reasonable and appropriate safeguards to protect Covered Entity’s PHI; (ii) any Subcontractors and agents that create, receive, maintain, or transmit PHI on behalf of Business Associate agree in writing to the same restrictions, conditions and requirements that apply through this Agreement to Business Associate with respect to such information; and (iii) any such Subcontractor or agent agrees to implement reasonable and appropriate safeguards to protect Covered Entity’s Electronic PHI.
