Use of Subcontractors and Agents. Business Associate shall ensure that any subcontractors or agents that create, receive, maintain or transmit PHI on behalf of Business Associate in connection with the Services it provides to Covered Entity under this Agreement shall agree to the same restrictions, conditions and requirements that apply to Business Associate with respect to such information, as provided in this Agreement, in accordance with 45 C.F.R. §§ 164.502(e)(1)(ii) and 164.308(b)(2), by requiring subcontractors and agents to enter into a written business associate agreement with Business Associate, incorporating such restrictions, conditions and requirements.
