Common use of USE OF THE LICENSED MATERIAL Clause in Contracts

USE OF THE LICENSED MATERIAL. 3.1 Throughout the term of this Sub-Licence the Sub-Licensee may for Educational Purposes only: 3.1.1 make such local electronic copies of all or part of the Licensed Material as are necessary to ensure efficient use by Authorised Users, provided that such use is subject to all the terms and conditions of this Sub-Licence; 3.1.2 allow Authorised Users to access the Licensed Material by Secure Authentication in order to search, retrieve, display and view, and otherwise use portions thereof; 3.1.3 allow Authorised Users to electronically save parts of the Licensed Material; 3.1.4 allow Authorised Users to print out copies of individual articles from the Licensed Material; 3.1.5 provide single printed or electronic copies of individual articles from the Licensed Material at the request of individual Authorised Users; 3.1.6 supply to a library at universities or further education establishments in Germany (whether by post or fax) by way of inter library loan a single paper copy of an electronic original of an article from the Licensed Material; 3.1.7 incorporate parts of the Licensed Material in printed and electronic course packs and study packs hosted on a Secure Network, virtual learning environments, managed learning environments and multi-media works provided that by so doing parts of the Licensed Material will not be accessible to persons who are not Authorised Users. Each item shall carry appropriate acknowledgement of the source, listing title and copyright owner. Course packs in non-electronic non-print perceptible form, such as Braille, may also be offered to Authorised Users; 3.1.8 incorporate parts of the Licensed Material in printed or electronic form in assignments and portfolios, theses and in dissertations ("the Academic Works"), including reproductions of the Academic Works for personal use and library deposit, if such use conforms to the customary and usual practice of the Sub-Licensee provided that by so doing parts of the Licensed Material will not be accessible to persons who are not Authorised Users except that reproductions in printed or electronic form of Academic Works may be provided to sponsors of such Academic Works. Each item shall carry appropriate acknowledgement of the source, listing title and copyright owner. 3.1.9 display, download and print parts of the Licensed Material for the purpose of promotion of the Licensed Material, testing of the Licensed Material, or for training Authorised Users; 3.1.10 publicly display or publicly perform parts of the Licensed Material as part of a presentation at a seminar, conference, or workshop, or other such similar activity; 3.1.11 make such copies of training material and network such training material as may be required for the purpose of using the Licensed Material in accordance with this Agreement.

Each item shall carry appropriate acknowledgement of the source, listing title and copyright owner. Each item shall carry appropriate acknowledgement of the source, listing title and copyright owner.; 3.1.9 display, download and print parts of the Licensed Material for the purpose of promotion of the Licensed Material, testing of the Licensed Material, or for training Authorised Users; 3.1.10 publicly display or publicly perform parts of the Licensed Material as part of a presentation at a seminar, conference, or workshop, or other such similar activity; 3.1.11 make such copies of training material and network such training material as may be required for the purpose of using the Licensed Material in accordance with this AgreementSub-Licence; and 3.2 This Sub-Licence shall be deemed to complement and extend the rights of the Institution and Authorised Users under the Copyright, Designs and Patents Xxx 0000 and the Copyright (Visually Impaired Persons) Xxx 0000 and nothing in this Sub-Licence shall constitute a waiver of any statutory rights held by the Institution and Authorised Users from time to time under these Acts or any amending legislation.

USE OF THE LICENSED MATERIAL. 3.1 Throughout the term of this Sub-Licence the Sub-Licensee may for Educational Purposes onlyonly and subject to Section 4: 3.1.1 make such temporary local electronic copies of all or part of the Licensed Material as are necessary to ensure efficient use by Authorised Users, provided that such use is subject to all the terms and conditions of this Sub-Licence; 3.1.2 allow Authorised Users to access the Licensed Material by Secure Authentication in order to search, retrieve, display and view, and otherwise use portions thereof; 3.1.3 allow Authorised Users to electronically save parts of the Licensed Material; 3.1.4 allow Authorised Users to print out copies of individual articles from parts of the Licensed Material; 3.1.5 provide single printed or electronic copies of individual articles from parts of the Licensed Material at the request of individual Authorised Users; 3.1.6 supply to a an authorised user of another library at universities or further education establishments in Germany (whether by post post, fax or faxsecure electronic transmission, using Ariel software or its equivalent, whereby the electronic file is deleted immediately after printing) by way of inter library loan a single paper copy of an electronic original of an article from parts of the Licensed MaterialMaterial for other than collection building purposes; 3.1.7 incorporate parts of the Licensed Material for use by Authorised Users in printed and electronic course packs packs, study packs, resource lists and study packs hosted on a Secure Network, in any other material (including but not limited to multi-media works) to be used in the course of instruction and/or in virtual and managed environments (including but not limited to virtual learning environments, managed learning environments, virtual research environments and multi-media works provided that by so doing parts of the Licensed Material will not be accessible to persons who are not Authorised Userslibrary environments) hosted on a Secure Network. Each item shall carry appropriate acknowledgement of the source, listing title and copyright owner. Each item shall carry appropriate acknowledgement the title, author, Publisher and - if different than the author or Publisher – the copyright owner of the source, listing title and copyright ownerLicensed Material used in the Academic Works.; 3.1.9 display, download and print parts of the Licensed Material for the purpose of promotion of the Licensed Material, testing of the Licensed Material, or for training Authorised Users; 3.1.10 publicly display or publicly perform parts of the Licensed Material as part of a presentation at a seminar, conference, or workshop, or other such similar educational activity; 3.1.11 make such copies of training material and network such training material as may be required for the purpose of using the Licensed Material in accordance with this Sub-Licence; and 3.1.12 deposit the learning and teaching objects as referred to in Clause 3.1.7 in electronic repositories operated by the Sub-Licensee on a Secure Network and in the JORUM Repository. The access and use of such learning and teaching objects shall be limited to Authorised Users and subject the license granted hereunder and may also be governed by the terms and conditions of the applicable repository to the extent that with respect to use of and access to the Licensed Materials such repository’s terms and conditions are consistent with this Sub-License Archive Agreement. . 3.2 This Sub-Licence shall be deemed to complement and extend the rights of the Institution and Authorised Users under the Copyright, Designs and Patents Xxx 0000 and the Copyright (Visually Impaired Persons) Xxx 0000 and nothing in this Sub-Licence shall constitute a waiver of any statutory rights held by the Institution and Authorised Users from time to time under these Acts or any amending legislation, provided that all the licence terms of use (including any permitted uses, restrictions, rights or obligations) contained in this Agreement shall apply without regard to whether the duration of copyright or database protection has expired under applicable law as such rights relate either to the database licensed hereunder or to the contents included therein.

USE OF THE LICENSED MATERIAL. 3.1 Throughout the term of this This Sub-Licence permits the Sub-Licensee may for Educational Purposes onlyonly to: 3.1.1 make such local supply to another library in the United Kingdom (whether by post, fax or secure electronic transmission provided the electronic file is deleted immediately after printing) a single paper copy of an electronic original of an individual document; 3.1.2 provide single printed or electronic copies of all or part single articles at the request of individual Authorised Users; 3.1.3 display, download and print parts of the Licensed Material as are necessary to ensure efficient use by for the purpose of promoting or testing the Licensed Material or for training Authorised Users, provided that such use is subject to all ; 3.1.4 make and distribute copies of training material as may be required for the terms and conditions purpose of using the Licensed Material in accordance with this Sub-Licence; 3.1.2 3.1.5 mount and use Metadata in bespoke and commercially available library systems to manage library operations; 3.1.6 allow Authorised Users to for Educational Purposes only to: 3.1.6.1 access the Licensed Material by Secure Authentication in order to search, retrieve, display and view, and otherwise use portions thereofview the Licensed Material; 3.1.3 allow Authorised Users 3.1.6.2 Modify the Metadata and to create new Metadata of the Licensed Material; 3.1.6.3 electronically save parts of the Licensed MaterialMaterial and Modifications; 3.1.4 allow Authorised Users to 3.1.6.4 print out single copies of individual articles from the Licensed Material; 3.1.5 provide single printed or electronic copies parts of individual articles from the Licensed Material at the request of individual Authorised Usersand Modifications; 3.1.6 supply to a library at universities or further education establishments in Germany (whether by post or fax) by way of inter library loan a single paper copy of an electronic original of an article from the Licensed Material; 3.1.7 3.1.6.5 incorporate parts of the Licensed Material and Modifications in printed and electronic course packs and study packs to be used in the course of instruction and/or in virtual learning environments hosted on a Secure Network, virtual learning environments, managed learning environments .Authorised Users must specify the title and multi-media works provided that by so doing parts copyright owner of the Licensed Material will not be accessible used in the course packs. To the best of their ability Authorised Users should use the durable links provided in the Licensed Material to persons who are not Authorised Usersincorporate individual articles in electronic course packs. Each item shall carry appropriate acknowledgement of the source, listing title and copyright owner. Course packs in non-electronic non-print perceptible formother formats, such as Braille, may also be offered to Authorised Users; 3.1.8 3.1.6.6 incorporate parts of the Licensed Material and Modifications in printed or electronic form in assignments and portfolios, theses and in dissertations ("“the Academic Works"”), including and to make reproductions of the Academic Works for personal use and library deposit, if such use conforms to the customary and usual practice . Reproductions of the Sub-Licensee provided that by so doing parts of the Licensed Material will not be accessible to persons who are not Authorised Users except that reproductions in printed or electronic form of Academic Works may can be provided to sponsors of such those Academic Works. Each item shall carry appropriate acknowledgement of Authorised Users must specify the source, listing title and copyright owner. 3.1.9 display, download and print parts owner of the Licensed Material for used in the purpose of promotion of the Licensed Material, testing of the Licensed Material, or for training Authorised Users;Academic Works. 3.1.10 3.1.6.7 publicly display or publicly perform parts of the Licensed Material as part of a presentation at a seminar, conference, or workshop, or other such similar activity;event; and 3.1.11 make such copies 3.1.6.8 save and/or deposit in perpetuity parts of training material and network such training material as may be required for the purpose of using the Licensed Material and Modifications in accordance with electronic repositories operated by the Sub-Licensee and/or by an Authorised User on a Secure Network. Access to and use of such repositories shall be limited to Authorised Users. 3.2 This Sub-Licence shall be deemed to complement and extend the rights of the Sub-Licensee and Authorised Users under the Copyright, Designs and Patents Act 1988 and the Copyright (Visually Impaired Persons) Act 2002 and nothing in this AgreementSub-Licence shall constitute a waiver of any statutory rights held by the Sub-Licensee and Authorised Users from time to time under these Acts or any amending legislation.
