Common use of Use of Transfer Agent's Name Clause in Contracts

Use of Transfer Agent's Name. The Trust shall not use the name of ----------------------------- the Transfer Agent in any Prospectus, Statement of Additional Information, shareholders' report, sales literature or other material relating to the Trust in a manner not approved prior thereto in writing; provided, that the Transfer Agent shall approve all reasonable uses of its name which merely refer in accurate terms to its appointment hereunder or which are required by the Commission or a state securities commission.

Use of Transfer Agent's Name.
