Utility Participants. As used in this Agreement, a “Utility Participant” shall mean, collectively and individually as the context requires, Company and each other public or investor-owned utility company participating in the funding of the Program. Each Utility Participant shall be a third-party beneficiary under this Agreement and shall be entitled to enforce Contractor’s obligations under this Agreement.
