Common use of Value Added Taxes Clause in Contracts

Value Added Taxes. (a) Any amount payable under a Finance Document by the Borrower is exclusive of any value added tax or any other Tax of a similar nature which might be chargeable in connection with that amount. If any such Tax is chargeable, the Borrower must pay to the Lender (in addition to and at the same time as paying that amount) an amount equal to the amount of that Tax.

Value Added Taxes. (a) Any amount (including costs, fees and expenses) payable under a Finance Document by the Borrower Company is exclusive of any value added tax or any other Tax of a similar nature which tax that might be chargeable in connection with that amount. If any such Tax value added tax or similar tax is chargeable, the Borrower Company must pay to the Lender (in addition to and at the same time as paying it pays that amount) an amount equal to the amount of that Taxvalue added tax or similar tax.
