Common use of Variable O&M Clause in Contracts

Variable O&M. Commencing on the Commercial Operation Date, the Department shall pay the Seller a payment for the variable costs of operation and maintenance associated with Energy delivered by the Seller from the Facility pursuant to the Department's Schedule or Dispatch determined pursuant to a Management Agreement (the “Variable O&M Payment”), on a monthly basis in arrears.
