VARIATION IN ESTIMATED QUANTITY. If the quantity of a unit-priced item in this Contract is an estimated quantity and the actual quantity of the unit-priced item varies more than ten percent (10%) above or below the estimated quantity, an equitable adjustment in the Contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above one hundred ten percent (110%) or below ninety percent (90%) of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request (in writing) an extension of time to be received by the Contracting Officer within ten (10) days from the beginning of the delay, or within such further period as may be granted by the Contract- ing Officer before the date of final settlement of the Contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgment of the Contracting Officer, is justified.

VARIATION IN ESTIMATED QUANTITY. If the quantity of a unit priced item in this Contract is an estimated quantity, and the actual quantities ordered exceeds the estimate by 50% or more, then the County may negotiate a lower unit price, which will be incorporated into the Contract by Contract Amendment. Failure of the Contractor to agree to a reduced unit price may result in the termination of the Contract and re-solicitation of the requirement.

VARIATION IN ESTIMATED QUANTITY. If the quantity of an item in this contract varies more than 15% (fifteen percent) above or below the original contract price, an equitable adjustment shall be negotiated between the Agency and Contractor. Any changes from the original contract must be coordinated with the County and the NRCS Government Representative. In the event an equitable adjustment is agreed upon, it must be incorporated by written modification, signed and dated by the County and Contractor. If the quantity variation is such as to cause an increase in the time necessary for completion, the contractor may request, in writing, an extension of time. Upon the receipt of a written request for an extension, the County shall ascertain the facts and coordinate with the NRCS Government Representative. The equitable adjustment shall be made upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in time necessary for completion of that Construction Work Package, the Contractor may request, in writing, an extension of time for the completion of that Construction Work Package, which it must submit to the Contracting Officer within ten (10) days from the beginning of the delay due to such variation, or, if deemed appropriate by the Contracting Officer in his sole and absolute discretion, within such further period as may be granted in writing by the Contracting Officer, but in no case shall such further period extend beyond the date of final payment for that Construction Work Package. Upon the receipt of such written request for an extension of time, the Contracting Officer shall ascertain the facts and make an adjustment to the time for completing that Construction Work Package as, in the judgement of the Contracting Officer, is justified. Under no circumstances shall this Section 11.9 apply to CMR Construction Services General Conditions or the CMR Construction Services General Conditions Fee included in a Task Order Price.
