Variation of Train Operations Agreements and Operator nominations. If Aurizon Network gives the End User a Notice of Intention to Increase Nominal Payload in respect of a Train Service Type, then, unless the Notice of Intention to Increase Nominal Payload is withdrawn under clause 10.5, with effect on the Effective Date the End User will be deemed to have given a notice to Aurizon Network in accordance with clause 3.4(a) varying the Access Rights which the End User has allocated to each Operator under a Train Operations Agreement in respect of that Train Service Type:
