Common use of Variation to Train Service Description Clause in Contracts

Variation to Train Service Description. If Aurizon Network gives the End User a Notice of Intention to Increase Nominal Payload in respect of a Train Service Type, then, unless the Notice of Intention to Increase Nominal Payload is withdrawn under clause 10.5, with effect on the Effective Date: (a) the Nominal Payload for the Train Service Type will be taken to be varied to be the Revised Nominal Payload for the Train Service Type; (b) the Maximum Payload for the Train Service Type will be taken to be varied to be the Revised Maximum Payload for the Train Service Type; and (c) the Nominated Monthly Train Services for the Train Service Type will be taken to be varied to be the Revised Nominated Monthly Train Services for the Train Service Type, as: (d) specified in the relevant Notice of Intention to Increase Nominal Payload; or (e) if clause 10.4(c) applies, agreed or determined through the Dispute resolution process under clause 24.

If Aurizon Network gives the End User Operator a Notice of Intention to Increase Nominal Payload in respect of a Train Service Type, then, unless the Notice of Intention to Increase Nominal Payload is withdrawn under clause 10.512.6, with effect on the Effective Date: (a) the Nominal Payload for the Train Service Type will be taken to be varied to be the Revised Nominal Payload for the Train Service Type; (b) the Maximum Payload for the Train Service Type will be taken to be varied to be the Revised Maximum Payload for the Train Service Type; and (c) the Nominated Monthly Train Services for the Train Service Type will be taken to be varied to be the Revised Nominated Monthly Train Services for the Train Service Type, as: (d) specified in the relevant Notice of Intention to Increase Nominal Payload; or (e) if clause 10.4(c12.4(c) applies, agreed or determined through the Dispute resolution process under clause 2437.

If Aurizon Network gives the End User a Notice of Intention to Increase Nominal Payload in respect of a Train Service Type, then, unless the Notice of Intention to Increase Nominal Payload is withdrawn under clause 10.59.5,10.5, with effect on the Effective Date: (a) the Nominal Payload for the Train Service Type will be taken to be varied to be the Revised Nominal Payload for the Train Service Type; (b) the Maximum Payload for the Train Service Type will be taken to be varied to be the Revised Maximum Payload for the Train Service Type; and (c) the Nominated Monthly Train Services for the Train Service Type will be taken to be varied to be the Revised Nominated Monthly Train Services for the Train Service Type, as: (d) specified in the relevant Notice of Intention to Increase Nominal Payload; or (e) if clause 10.4(c9.410.4(c) applies, agreed or determined through the Dispute resolution process under clause 2423.24.
