Vendor Condition #1. Within thirty (30) days from the Purchaser delivering a waiver of the Purchaser's conditions, the Vendor shall have obtained the approvals of the Lieutenant Governor-in-Council pursuant to section 194 of the Education Act, R.S.O. 1990, c. E.2 and the Vendor’s Board of Trustees for the sale of the Property to the Purchaser, which approvals the Purchaser acknowledges may be arbitrarily and unreasonably withheld and the Vendor shall notify the Purchaser if and when such approvals are obtained. The Purchaser agrees that should the Vendor be unable to satisfy this condition within said thirty (30) day period, then the Vendor may, at its option and in its sole discretion, extend this time period for an additional thirty (30) days by notice in writing to the Purchaser within the initial thirty (30) day period.

  • SUPERIOR CONDITIONS 21.01 All existing benefits, rights, privileges, practices, terms or conditions of employment which may be considered to be superior to those contained herein and which are set out in Appendix 4 are specifically retained by this Agreement unless otherwise agreed by the local parties. The parties agree to remove from Appendix 4 those superior conditions which no longer have application. Where the parties cannot agree on whether a superior condition continues to have application, the issue will be reduced to a grievance and referred to arbitration.
