Unsafe Work Conditions. No Employee shall be disciplined for refusal to work on a job which in the opinion of:
(a) A member of a safety committee; or
(b) A person designated by a safety committee; or
(c) A safety officer after an on-site inspection and following discussion with a representative of the Employer, does not meet the standards established pursuant to the Workers' Compensation Act.
Unsafe Work Conditions. No employee shall be disciplined for exercising his/her right to refuse to do unsafe work pursuant to Section 3.24 of the Industrial Health and Safety Regulations.
Unsafe Work Conditions. No employee shall be disciplined for refusal to work on an assignment which, in the opinion of:
(a) a member of the workplace Health and Safety Committee; or
(b) a person designated by a safety committee; or
(c) a safety officer; or
(d) a xxxxxxx at a worksite where there is no safety committee; after an on-site inspection and following discussion with a representative of the Employer, does not meet the standards established pursuant to the Workers' Compensation Act. Where an employee acts in compliance with Section 8.24 of the Workers' Compensation Board Occupational Health and Safety Regulations, he/she shall not be subject to disciplinary action.
Unsafe Work Conditions. No employee shall be disciplined for refusal to work on an assignment which, in the opinion of:
(a) a member of the Local Occupational Health and Safety Committee, or
(b) a person designated by a safety committee, or
(c) a safety officer, or
(d) a xxxxxxx at a worksite where there is no safety committee, after an on-site inspection and following discussion with a representative of the Employer, does not meet the standards established pursuant to the Workers Compensation Act. Where an employee acts in compliance with Occupational Health and Safety Regulation, Part 3, Section 3.12, they shall not be subject to disciplinary action.
Unsafe Work Conditions. Where an employee, in good faith, acts in compliance with Section 8.24 of the Workers' Compensation Board Industrial Health and Safety Regulations, he/she shall not be subject to disciplinary action.
Unsafe Work Conditions. No employee shall be disciplined for refusal to work on a job which the employee has reasonable cause to believe is unsafe. Resolution of the issue shall be pursuant to Article 8.24 of the WCB Industrial Health and Safety Regulations.
Unsafe Work Conditions a) No employee shall be disciplined for refusal to work on a job which in the opinion of:
i) a member of a safety committee, or
ii) a person designated by a safety committee, or
iii) a safety officer after an on-site inspection and following discussion with a representative of the Employer, does not meet the standards established pursuant to the Workers' Compensation Act. A worker may refuse to perform work where he/she has reasonable grounds to believe and does believe that the particular work is dangerous to his/her health and safety, or the health and safety of another worker or another person. Where a worker refuses to do such work no other worker may be asked to perform that job until the matter has been investigated by the Health and Safety Committee and satisfactorily settled. The Employer or any person acting on behalf of the Employer shall not take or threaten any discriminatory action against any employee or employees for refusing to do such work.
Unsafe Work Conditions. (a) An employee may exercise their right to refuse to do unsafe work pursuant to Section 3.12 of the Occupational Health and Safety Regulation outlined in Information Appendix B and Part 3, Division 6 of the Workers Compensation Act.
(b) An employee must not be subject to discriminatory or disciplinary action pursuant to Section 3.13(1) of the Occupational Health and Safety Regulations outlined in Information Appendix B and Part 3, Division 6 of the Workers Compensation Act.
Unsafe Work Conditions. No employee will be disciplined for refusal to work on assignment which, in the opinion of a safety committee member or xxxxxxx, after an on-site inspection and following discussion with a representative of the Employer, does not meet the standards established pursuant to the Workers Compensation Act. Where an employee acts in compliance with Part 3 of the WorkSafeBC Occupational Health and Safety Regulations, they will not be subject to disciplinary action.
Unsafe Work Conditions. (a) No employee shall be disciplined for refusal to work on a job, which the employee believes to be unsafe pursuant to the Workers Compensation Act.
(b) Any employee claiming the right to refuse such work must immediately report the unsafe situation to local management. A local management representative and a union shop xxxxxxx or union health and safety representative will investigate the situation. Should this investigation result in a disagreement as to the safety of the job, the parties shall immediately request an inspection and determination by an inspector from the Workers' Compensation Board.
