Vibration Event. All of the following occur: (i) a Noticed Vibration Event occurs and (ii) the Vibration Limit was exceeded as a result of construction of the Support System or the Subgrade Work and (iii) Licensee fails to effect a Vibration Event Cure within one (1) hour following Licensor’s notice thereof.
