Common use of Wage Rate Protected Clause in Contracts

Wage Rate Protected. If in the event of reorganization, recall, elimination of positions or classifications an employee is assigned to a lower paid position or classification the employee, while employed in such position, shall continue to receive their previous basic rate of pay until the basic rate of pay for the lower paid classification is equal to or greater than their previous basic rate of pay, at which time they will then receive the basic rate of pay for the classification to which the position is allocated.
