Common use of Waiver and Condoning Clause in Contracts

Waiver and Condoning. Any condoning, excusing or overlooking by the Landlord of any default by the Tenant will not operate as a waiver of the Landlord's rights hereunder in respect of any subsequent default and a receipt by the Landlord of any Rent, or any other sum payable hereunder with knowledge of the breach of any covenant or agreement contained in this Lease will not constitute a waiver of such breach. No waiver by the Landlord of any provision of this Lease will be deemed to have been made unless expressed in writing and signed by the Landlord.
