Common use of Waiver and Release of Unknown Claims Clause in Contracts

Waiver and Release of Unknown Claims. You further understand and agree that as a condition of this Agreement, you hereby expressly waive and relinquish any and all claims, rights or benefits that you may have under California Civil Code section 1542, which provides as follows: “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.” In connection with such waiver and relinquishment, you hereby acknowledge that you may hereafter discover claims or facts in addition to, or different from, those which you now know or believe to exist, but that you expressly agree to fully, finally and forever settle and release any and all claims, known or unknown, suspected or unsuspected, which exist or may exist on your behalf against the Released Parties at the time of execution of this Agreement, including, but not limited to, any and all claims relating to or arising from your employment with the Company or the termination of that employment.
