Common use of WAIVER AND SEVERABILITY OF TERMS Clause in Contracts

WAIVER AND SEVERABILITY OF TERMS. Lapasar’s failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision herein is found by a court of competent jurisdiction to be invalid, the Parties nevertheless agree that the court should endeavour to give effect to the Parties' intentions as reflected in the provision and to construe these Terms and Conditions to the maximum extent permitted by law so as to render that provision valid and enforceable, and all other provisions herein remain in full force and effect.
