Common use of Waiver of Damages for Delays Clause in Contracts

Waiver of Damages for Delays. Contractor shall not be entitled to, and hereby expressly waives recovery of, any compensation or damages of any kind or suffered or incurred by reason of the delays contemplated by this Article 9.3, and an extension of time shall constitute Contractor's sole remedy for such delays. Also, Owner's sole liability and Contractor's sole remedy under the Contract for delays caused by Owner, utility owners or any of Owner's other contractors, consultants, representatives or their agents or employees shall be an extension of time as provided in this Article 9.3.
