Common use of Waiver of Insurers Clause in Contracts

Waiver of Insurers. Each party shall cause each property insurance policy (other than the commercial general liability insurance) obtained by it to provide that the insurer waives all rights of recovery by way of subrogation against either Landlord or Tenant, as the case may be (or agrees that the coverage under such policy shall not be invalidated by the waivers set forth in Section 22.1 above), in connection with any claims, losses and damages covered by such policy or which would have been covered by such property insurance policy had such party obtained and maintained the insurance policy it was required to obtain and maintain (whichever is greater).
