Common use of Waiver of Jury Trial and Punitive Damages Clause in Contracts

Waiver of Jury Trial and Punitive Damages. Each party hereby absolutely, irrevocably and unconditionally waives trial by jury and the right to claim or receive special, consequential, punitive or exemplary damages arising out of, pertaining to or in any way associated with the covenants, undertakings, representations or warranties set forth in this Agreement, the relationships of the parties hereto, this Agreement or any other Transaction Agreement.
