Common use of Waiver of Mediation Rights Clause in Contracts

Waiver of Mediation Rights. Filing suit on a claim that, under this Article XXXII and the terms of this Agreement, first should be mediated waives the filer’s right to demand mediation. But one Party’s waiver does not affect another party’s right. A defendant does not waive mediation as long as, within a reasonable time after appearing, said defendant gives written notice to the plaintiff or its counsel of intent to require compliance with this Article XXXII.
