Common use of Waivers and remedies cumulative Clause in Contracts

Waivers and remedies cumulative. (a) The rights and remedies of each Party under this Agreement: (i) may be exercised as often as necessary; (ii) are cumulative and not exclusive of its rights and remedies under the general law; and (iii) may be waived only in writing and specifically. (b) No delay in exercising or non-exercise by a Party of any right or remedy under this Agreement shall operate as a waiver of that right or remedy, nor shall any single or partial exercise of any right or remedy prevent any further or other exercise or the exercise of any other right or remedy other than where any rights (including, without limitation, the right to require payment of any Guaranteed Amount) are to be exercised in accordance with specified requirements under this Agreement.
