Waiving Early Withdrawal Penalties. We will waive early withdrawal penalties in these circumstances: • Death of a TD owner or a grantor of a revocable family/living trust; • Disability of a retirement (i.e., IRA or Xxxxx) TD owner; • Court determination that a TD owner is incompetent; • Re-titling of a TD (excluding a retirement TD) to transfer ownership of funds into a living trust without moving funds from the Bank and where no change in term or rate occurs; and • For retirement TDs, if the owner is 59-1/2 years old or older and the funds are taken as an IRS-reportable distribution via cash, check, or deposit or transfer to a non-retirement account. This waiver does not apply if the Any instrument not finally paid (returned unpaid) will be deducted from your TD, and your TD may be canceled.

  • Early Withdrawal Penalty Unless provided otherwise in the Disclosures, we will assess an early withdrawal penalty on any withdrawal, either partial or in whole, that we allow you to make from your account prior to the account's maturity date. The method for determining that penalty is described in the Disclosures.

  • Early Withdrawal Provisions We will impose a penalty if You withdraw any of the principal funds before the maturity date. The penalty imposed will equal the sum of the $25.00 administrative fee plus 180 days of dividends on the amount withdrawn. Renewal Policies.   • Stipulated Penalties for Failure to Comply with Certain Obligations As a contractual remedy, Good Shepherd and OIG hereby agree that failure to comply with certain obligations as set forth in this CIA may lead to the imposition of the following monetary penalties (hereinafter referred to as “Stipulated Penalties”) in accordance with the following provisions. 1. A Stipulated Penalty of $2,500 (which shall begin to accrue on the day after the date the obligation became due) for each day Good Shepherd fails to establish and implement any of the following obligations as described in Sections III and IV: a. a Compliance Officer; b. a Compliance Committee; c. the management certification obligations; d. a written Code of Conduct; e. written Policies and Procedures; f. the development and/or implementation of a Training Plan for the training of Covered Persons, and Relevant Covered Persons; g. a risk assessment and internal review process as required by Section III.E; h. a Disclosure Program; i. Ineligible Persons screening and removal requirements; j. notification of Government investigations or legal proceedings; k. policies and procedures regarding the repayment of Overpayments; l. the repayment of Overpayments as required by Section III.I; m. reporting of Reportable Events; and n. disclosure of changes to business units or locations. 2. A Stipulated Penalty of $2,500 (which shall begin to accrue on the day after the date the obligation became due) for each day Good Shepherd fails to engage and use an IRO, as required in Section III.D, Appendix A, and Appendix B. 3. A Stipulated Penalty of $2,500 (which shall begin to accrue on the day after the date the obligation became due) for each day Good Shepherd fails to submit the Implementation Report or any Annual Reports to OIG in accordance with the requirements of Section V by the deadlines for submission. 4. A Stipulated Penalty of $2,500 (which shall begin to accrue on the day after the date the obligation became due) for each day Good Shepherd fails to submit any Claims Review Report in accordance with the requirements of Section III.D and Appendix B. 5. A Stipulated Penalty of $1,500 for each day Good Shepherd fails to grant access as required in Section VII. (This Stipulated Penalty shall begin to accrue on the date Good Shepherd fails to grant access.) 6. A Stipulated Penalty of $50,000 for each false certification submitted by or on behalf of Good Shepherd as part of its Implementation Report, Annual Report, additional documentation to a report (as requested by the OIG), or otherwise required by this CIA. 7. A Stipulated Penalty of $10,000 (which shall begin to accrue on the day after the date the obligation became due) for each day Good Shepherd fails to cooperate and otherwise satisfy any of the obligations and requirements as described in Section III.K. 8. A Stipulated Penalty of $1,000 for each day Good Shepherd fails to comply fully and adequately with any obligation of this CIA. OIG shall provide notice to Good Shepherd stating the specific grounds for its determination that Good Shepherd has failed to comply fully and adequately with the CIA obligation(s) at issue and steps Good Shepherd shall take to comply with the CIA. (This Stipulated Penalty shall begin to accrue 10 days after Good Shepherd receives this notice from OIG of the failure to comply.) A Stipulated Penalty as described in this Subsection shall not be demanded for any violation for which OIG has sought a Stipulated Penalty under Subsections 1-7 of this Section.

  • Civil Penalty Payment Method Xxxxxxxxx shall pay the civil penalty by check, credit card, wire transfer, or portal, payable to CARB, using instructions provided separately by CARB in a Payment Transmittal Form. Xxxxxxxxx is responsible for all payment processing fees. Payments shall be accompanied by the Payment Transmittal Form to ensure proper application. CARB shall deposit the civil penalty amount into the Air Pollution Control Fund for the purpose of carrying out CARB’s duties and functions to ensure the integrity of its air pollution control programs. Should payment instructions change, CARB will provide notice to Xxxxxxxxx in accordance with Paragraph 12 (Notices).

  • Administrative Penalty That Respondent shall pay an Administrative Penalty of $1,000.00 to the Participating States to be distributed equally amongst the Participating States (the “per-state payment”).
