War or terrorism Clause Samples
The 'War or terrorism' clause defines how contractual obligations are affected in the event of war, acts of terrorism, or related hostilities. Typically, this clause excuses one or both parties from performing their duties if such extraordinary events occur, recognizing that these situations are beyond the parties' control. For example, if a supplier cannot deliver goods due to a terrorist attack disrupting transportation, this clause may relieve them from liability for non-performance. Its core function is to allocate risk and provide clarity on the parties' responsibilities when unforeseen, large-scale disruptive events like war or terrorism arise.
