WARRANTIES AND CORRECTION OF THE WORK. 12.7.1 Constructor warrants that all materials and equipment shall be new (unless otherwise specified), of good quality, and in conformance with the Contract Documents. At Owner’s request, Constructor shall furnish satisfactory evidence of the quality and type of materials and equipment furnished. Constructor further warrants that the Work shall be free from material defects not intrinsic in the design or materials required in the Contract Documents. Constructor’s warranty does not include remedies for defects or damages caused by normal wear and tear during normal or excessive usage, use for a purpose for which the Project was not intended, improper or insufficient maintenance, modifications performed by Owner or Others, or abuse. Constructor’s warranty pursuant to this Section 12.7 shall commence on the date of Substantial Completion.
