Warranties by POZEN. POZEN warrants to Nycomed that Product, on delivery, (a) shall conform to the Specifications, as then in effect; (b) shall have been manufactured in accordance with (i) then-current good manufacturing practices as set forth in the “Rules Governing Medicinal Products in The European Community – Volume IV Good Manufacturing Practice for Medicinal Products” (“cGMPs”), and (ii) the [***] and (c) shall not be adulterated or misbranded within the meaning of the FD&C Act, or an article that may not be introduced into interstate commerce under the provisions of Sections 404 or 505 of the FD&C Act.
