Warranties for Deliverable Items. (a) SATELLITES. Contractor represents that each Satellite furnished under this Contract shall be free from Defects other than Defects waived in writing by Customer. This representation shall begin on the date of Initial Handover of a Satellite and Customer’s exclusive remedy for breach of this representation is set forth in Article 12 (In-Orbit Performance Incentive Payments).
