Common use of WARRANTY AND NOTICE OF DEFECT Clause in Contracts

WARRANTY AND NOTICE OF DEFECT. A. If Seller offers a warranty in addition to the provisions in Paragraph 7 of the Contract, (CONSTRUCTION STANDARDS AND TRANSFER OF WARRANTIES), Seller, or Seller’s Broker, if applicable, shall provide, at Seller’s expense, within five (5) days of the Time Reference Date a sample written warranty covering the Property, which shall be effective at Closing. Buyer shall have the time provided in Paragraph 5 of the Contract (INVESTIGATIONS, INSPECTIONS AND REVIEWS), to review the provisions of the warranty. In the event Buyer is dissatisfied with the provisions of the warranty, Buyer may cancel the Contract in accordance with Paragraph 5 of the Contract.
