Common use of Warranty of accuracy of information Clause in Contracts

Warranty of accuracy of information. (a) Subject to clause 3.10(b), each party represents and warrants to the other that all material information provided by the first-mentioned party to the other, whether pursuant to this agreement or otherwise, in relation to use of the Network is, to the first-mentioned party’s knowledge, accurate in all material respects and is not, whether by omission or otherwise, misleading. (b) Each party agrees that forward looking information is subject to uncertainties and that the warranty in clause 3.10(a) does not apply to forward looking information and representations as to future matters, however, each party must use reasonable endeavours, at the time such information is provided to the other party, to ensure the accuracy of the forward looking information and future representations, in so far as is reasonably practicable.
