Common use of WARRANTY OF FITNESS Clause in Contracts

WARRANTY OF FITNESS. FOR A PARTICULAR PURPOSE with respect to the subject Goods, and the Buyer agrees that the Buyer will accept the Goods without any warranty of merchantability or any warranty of fitness for a particular purpose. The Goods being sold Pursuant to this Purchase Agreement are being sold on an “AS IS” basis. The entire risk as to the quality and performance of the Goods is with the Buyer.
