Common use of Water Service Provisions Clause in Contracts

Water Service Provisions. 1.1 City shall provide water service to Customer at the point(s) of delivery for Customer as mutually agreed upon between City and Customer in writing. City shall provide water service to Customer in the same manner as such services are provided to residents of the City of Shreveport and other water system customers. Any provision of this Agreement to the contrary notwithstanding, Customer acknowledges, understands and agrees that water service may be temporarily interrupted, suspended or reduced by City for reasons which may include, but are not limited to the following: a) declaration of general emergency by the Director of the Department of Water and Sewerage or his/her authorized designee; b) to install equipment, make repairs, replacements, investigations and inspections or perform other maintenance work on the system or those parts of the system supplying water service to Customer; c) a break, outage, or interruption of the City supply or delivery system; d) Force Majeure conditions as described in Article of this Agreement. 1.2 City shall be responsible for operation and maintenance of water purification, treatment, pumping and delivery facilities up to the point of delivery. 1.3 Customer shall be responsible for providing and for the operation and maintenance of all facilities beyond the point of delivery.
