Well Status. There are no Xxxxx located on the Properties that: (a) Seller is currently obligated by law or contract to plug and abandon; (b) Seller will not be obligated by law or contract to plug or abandon with the lapse of time or notice or both because the Well is not currently capable of producing in commercial quantities; (c) are subject to exceptions to a requirement to plug and abandon issued by a regulatory authority having jurisdiction over the Properties; or, (d) to the best knowledge of Seller, have been plugged and abandoned but have not been plugged in accordance with all applicable requirements of each regulatory authority having jurisdiction over the Properties.
Well Status. Except as set forth in Schedule 6.13, there are no xxxxx located on the Assets that: (a) Seller is obligated by Law or contract to currently plug and abandon; or (b) to the extent plugged and abandoned, have not been plugged in accordance with applicable material requirements of each Governmental Entity having jurisdiction over the Assets.
Well Status. There are no xxxxx included in the Assets that (a) Seller is obligated by law or contract to currently plug and abandon or (b) are subject to exceptions to a requirement to plug and abandon issued by a governmental authority.
Well Status. Schedule 4.20 sets forth a description of each existing well included in the Assets or otherwise located on the Subject Properties, along with accurate information regarding its current status. No capital expenditures are currently required for any Subject Property or any xxxxx located on any Subject Property, including any plugging and abandonment obligations, except as provided on Schedule 4.20. To the Knowledge of Seller, all xxxxx located on any Subject Property that have been plugged and abandoned were plugged and abandoned in all material respects in accordance with applicable Law.

As of the date of this Agreement, the Partnership's accrued plugging and abandonment liabilities are less than $100,000 with respect to all wellx xxxated on the Oil and Gas Properties that (i) Titan is currently obligated by law or contract to presently plug and abandon; (ii) Titan will be obligated by law or contract to plug and abandon with the lapse of time or notice or both because the well is not currently capable of producing Substances in commercial quantities or otherwise currently being used in normal operations; (iii) are subject to exceptions to a requirement to plug and abandon issued by a regulatory authority having jurisdiction over the Oil and Gas Properties; or (iv) to the best knowledge of Titan, have been plugged and abandoned but have not been plugged in accordance in all material respects with all applicable requirements of each regulatory authority having jurisdiction over the Oil and Gas Properties.

To the Knowledge of Laramie, there are no xxxxx located on the Laramie Assets that: (a) Laramie is obligated by Law or contract to currently plug and abandon; or (b) have been plugged and abandoned but have not been plugged in accordance with all applicable requirements of each regulatory authority having jurisdiction of the Laramie Assets.

To the Knowledge of Delta, there are no xxxxx located on the Delta Assets that: (a) Delta is obligated by Law or contract to currently plug and abandon; or (b) have been plugged and abandoned but have not been plugged in accordance with all applicable requirements of each regulatory authority having jurisdiction of the Delta Assets.

To the Knowledge of Seller, as of the date of this Agreement, with respect to Assets for which Seller is the operator, there are no Xxxxx that (i) Seller is currently obligated by law or contract to presently plug and abandon, or (ii) to Seller's Knowledge, have been plugged and abandoned but have not been plugged in accordance in all material respects with all applicable requirements of each regulatory authority having jurisdiction over the Assets.
