Common use of Where a Contracting Party Clause in Contracts

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, and in which investors of the other Contracting Party own shares, it shall ensure that the provisions of this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those shares.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, laws and regulations and in which investors of the other Contracting Party own sharesshares or other forms of participation, it shall ensure that the provisions of paragraphs (1) and (2) of this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those sharesshall be applied.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territorylaws and regulations, and in which investors of the other Contracting Party participate or own sharesshares or debentures, it shall ensure that the provisions provision of this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those sharesshall be applied.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territorylaws and regulations, and in which investors of the other Contracting Party own shares, it shall ensure that debentures or other forms of participation, the provisions of this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those sharesshall be applied.

Where a Contracting Party. expropriates the assets of a company which legal entity that is incorporated or constituted under the law in force in any part of its own territory, territory according to its laws and regulations and in which investors of the other Contracting Party own sharesparticipate, it shall ensure that the provisions of this Article are applied so as to guarantee prompt, in a way that it guarantees such investors adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those sharescompensation.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, and in which investors of the other Contracting Party own shares, it shall ensure that the provisions of paragraph 1 of this Article are applied so as to the extent necessary to guarantee prompt, adequate and effective reasonable compensation to such investors in respect of their investment to such investors of the other Contracting Party who are owners of those shares.

Where a Contracting Party. expropriates the assets of a company company, which is incorporated or constituted under the law in force in any part of its own territorylaws and regulations, and in which investors of the other Contracting Party own shares, it shall ensure that debentures or other forms of participation, the provisions of this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those sharesshall be applied.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, and in which investors nationals or companies of the other Contracting Party own shares, it shall ensure that the provisions of paragraphs (1) and (2) of this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those sharesshall apply.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territorylaws and regulations, and in which investors of the other Contracting Party own shares, it shall ensure that debentures or other forms of participation, the provisions provision of this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those sharesshall be applied.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, and in which investors the iavestors of the other Contracting Party own shares, it shall ensure that the provisions of paragraphs (1) to (4) of this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those sharesshall apply.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, and in which investors of the other Contracting Party own sharesshares or debentures, it shall ensure that the provisions of this Article are applied so as to the extent necessary to guarantee prompt, adequate and effective compensation in respect of their investment investments to such investors of the other Contracting Party who are owners of those sharesshares or debentures.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territoryarea, and in which investors of the other Contracting Party own shares, it shall ensure that the provisions of paragraph (1) of this Article are applied so as to the extent necessary to guarantee prompt, adequate and effective compensation referred to in paragraph (1) of this Article in respect of their investment to such investors of the other Contracting Party who are owners of those shares.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, and in which investors of the other Contracting Party own shares, it shall ensure that the provisions Volume 2398, I-43301 Provisions of this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those shares.

Where a Contracting Party. expropriates the assets of a company which that is incorporated or constituted under the law in its territory according to its laws in force in any part of its own territory, and in which investors of the other Contracting Party own sharesparticipate, it shall ensure that the provisions of this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment to such a way that it guarantees such investors of the other Contracting Party who are owners of those sharesa fair and equitable compensation.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, and in which investors of the other Contracting Party own shares, it shall ensure that the provisions of this Article are applied so as to the extent necessary to guarantee prompt, adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those shares.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, and in which investors of the other Contracting Party own shares, it shall ensure that the provisions of paragraph 1 of this Article are applied so as to the extent necessary to guarantee prompt, adequate and effective reasonable compensation in respect of their investment to such investors investor of the other Contracting Party who are owners of those shares.

Where a Contracting Party. expropriates the assets of a company which is was incorporated or constituted under the law in force in any part of its own territory, and in which investors of the other Contracting Party own shares, it shall ensure that the provisions of paragraphs 1 to 3 of this Article are applied so as to the extent necessary to guarantee prompt, adequate and effective reasonable compensation in respect of their investment investments to such investors of the other Contracting Party who are owners of those shares.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, territory and in which investors of the other Contracting Party own sharesshares or debentures, it shall ensure that the provisions of paragraph (1) of this Article are applied so as to the extent necessary to guarantee prompt, adequate and effective compensation in respect of their investment to of such investors of the other Contracting Party who are owners of those sharesshares or debentures.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, and in which investors nationals or companies of the other Contracting Party own shares, it shall ensure that the provisions of paragraphs (1) to (4) of this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those sharesshall apply.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law an enterprise in force in any part of its own territory, and territory in which investors of the other Contracting Party own have an investment, including through the ownership of shares, it shall ensure that the provisions of this Article are applied so as to the extent necessary to guarantee prompt, adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those sharesParty.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law according to its legislation in force in any part of its own territory, and in which investors of the other Contracting Party own shares, it shall ensure that the provisions of this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those sharesParty.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, and in which investors nationals or companies of the other Contracting Party own shares, it shall ensure that the provisions of paragraph (1) of this Article are applied so as to the extent necessary to guarantee prompt, adequate and effective compensation in respect of their investment to such investors nationals or companies of the other Contracting Party who are owners of those shares.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, and in which investors of the other Contracting Party own shares, it shall ensure that the provisions of this Article are applied so as to guarantee prompt, adequate the extent necessary to ensure fair and effective equitable compensation in respect of their investment to such investors of the other Contracting Party who are owners of those shares.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law legal person established in force its territory in any part of accordance with its own territory, laws and in which regulations and involving investors of the other Contracting Party own sharesParty, it shall ensure that the provisions of this Article are applied so as to guarantee prompt, in a manner which guarantees adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those sharesinvestors.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, and in which investors nationals or companies of the other Contracting Party own shares, it shall ensure that the provisions provision of paragraph 1) of this Article are applied so as to the extent necessary to guarantee prompt, adequate and effective compensation in respect of to their investment to such investors nationals or companies of the other Contracting Party who are owners of those shares.

Where a Contracting Party. expropriates the assets of a company which is incorporated or legal person constituted under the law in force its territory in any part of accordance with its own territory, laws and regulations and in which investors of the other from another Contracting Party own sharesparticipate, it shall ensure that the provisions of this Article are applied so shall apply to its participation in such legal person in such a manner as to guarantee prompt, adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those sharesinvestors.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, and in which investors of the other Contracting Party own shares, it shall ensure shall, to the extent necessary and subject to its laws, ensure, that the provisions of compensation according to this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment will be made available to such investors of the other Contracting Party who are owners of those sharesinvestors.

Where a Contracting Party. expropriates the a assets of a company which is incorporated or constituted under the law in force in any part of its own territory, and in which investors nationals or companies of the other Contracting contracting Party own shares, it shall ensure that the provisions of paragraph (1) of this Article are applied so as to the extent necessary to guarantee prompt, adequate and effective compensation in respect of their investment to such investors nationals or companies of the other Contracting Party who are owners of those shares.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, territory and in which investors of the other Contracting Party own shares, it shall ensure that the provisions provision of paragraph 1 of this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those sharesshall be applied.

Where a Contracting Party. expropriates the assets of a company which legal entity that is incorporated or constituted under the law in force in any part of its own territory, territory according to its laws and regulations and in which investors of the other Contracting Party own sharesparticipate, it shall itshall ensure that the provisions of this Article are applied so as to guarantee prompt, in a way that it guarantees such investors adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those sharescompensation.

Where a Contracting Party. expropriates the assets of a company which is was incorporated or constituted under the law in force in any part of its own territory, and in which investors of the other Contracting Party own shares, it shall ensure that the provisions of paragraphs 1 to 3 of this Article are applied so as to the extent necessary to guarantee prompt, adequate and effective reasonable compensation in respect of their investment investments to such investors of the other Contracting Party who are owners of those shares.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, and in which investors of the other Contracting Party own shares, it shall ensure that the provisions of this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment investments to such investors of the other Contracting Party who are owners of those shares.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under the law in force in any part of its own territory, and in which investors of the other Contracting Party own shares, it shall shall, to the extent necessary and subject to its laws, ensure that the provisions compensation according to paragraph (1) of this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment will be made available to such investors of the other Contracting Party who are owners of those sharesinvestors.

Where a Contracting Party. expropriates the assets of a company legal person which is incorporated or constituted under the law in force in any part of its own territory, and in which investors of the other Contracting Party own shares, it shall ensure that the provisions of paragraph (1) of this Article are applied so as to guarantee prompt, adequate the extent necessary to ensure fair and effective equitable compensation in respect of their investment to such investors of the other Contracting Party who are owners of those shares.

Where a Contracting Party. expropriates the assets of a company legal entity which is incorporated or constituted under the law in force in any part of its own territory, and in which investors of the other Contracting Party own shares, it shall ensure shall, to the extent necessary and subject to its laws, ensure, that the provisions compensation according to paragraph (1) of this Article are applied so as to guarantee prompt, adequate and effective compensation in respect of their investment will be made available to such investors of the other Contracting Party who are owners of those sharesinvestors.

Where a Contracting Party. expropriates the assets of a company which is was incorporated or constituted under the law in force in any part of its own territory, and in which investors of the other Contracting Party own shares, it shall ensure that the provisions of paragraphs 1 to 3 of this Article are applied so as to the extent necessary to guarantee prompt, adequate and effective reasonable compensation in respect of their investment investments to such investors of the other Contracting Party who are owners arerowners of those shares.

Where a Contracting Party. expropriates the assets of a company which is incorporated or constituted under in accordance with the law in force in any part of its own territory, and in which investors of the other Contracting Party hold a stake or own shares, it shall ensure that the provisions of this Article are applied so as to guarantee prompt, adequate and effective ef- fective compensation in respect of their investment to such the investors of the other Contracting Contract- ing Party who are owners of those said stakes or shares.

Where a Contracting Party. expropriates the assets of a company which legal entity that is incorporated or constituted under the law in force in any part of its own territory, territory according to its taws and regulations and in which investors of the other Contracting Party own sharesparticipate, it shall ensure that the provisions of this Article are applied so as to guarantee prompt, in a way that it guarantees such investors adequate and effective compensation in respect of their investment to such investors of the other Contracting Party who are owners of those sharescompensation.

Where a Contracting Party. expropriates the assets of a company which is incorporated Incorporated or constituted under the law in force in any part of its own territory, and in which investors of the other Contracting Party own shares, it shall ensure that the provisions of this Article are applied so as to guarantee prompt, adequate the extent necessary to ensure fair and effective equitable compensation in respect of their investment to such investors of the other Contracting Party who are owners of those shares.
