WHOLE CONTRACT. This Contract constitutes the complete and exclusive statement of the Contract between the parties relevant to the purpose described herein and supersedes all prior agreements or proposals, oral or written, and all other communication between the parties relating to the subject matter of this Contract.
WHOLE CONTRACT. This Agreement constitutes the entire contract between the parties and any representation, terms, conditions or warranties not contained in this Agreement shall not be binding on the parties.
WHOLE CONTRACT. 20.1. This Agreement constitutes the whole agreement between the parties and neither of the parties shall be bound by any terms, conditions, representations, warranties, amendments or the like unless reduced to writing and signed by both parties.
20.2. No alteration, variation or addition to this Agreement shall be of any force or effect unless and until it shall have been reduced to writing and signed by both parties.
20.3. If any clause or terms of this Agreement should be invalid, unenforceable or illegal, then the remaining terms of this Agreement shall be deemed to be severable therefrom and shall continue to be in full force and effect, unless such invalidity, unenforceability or illegality goes to the root of this Agreement.
20.4. The Purchaser declares himself to be fully aware that the property forms part of land that has been made available to the Contractor for development. It is specifically recorded that the Seller is NOT a party to the agreement to be entered into between the Purchaser and the Contractor as set out in clause 11 above and the Seller shall not be held responsible for any obligations of the Contractor towards the Purchaser in terms of such Building Contract.
WHOLE CONTRACT. This document may not be modified, varied or consensually cancelled other than in writing, duly signed by both parties. If the estate agent or any other person has made any representations, warranties or undertakings to the EMPLOYER regarding the WORKS, then EMPLOYER records these in the space provided below so that the CONTRACTOR may be aware of those representations, warranties or undertakings. Should nothing be recorded on the version of this AGREEMENT signed by the CONTRACTOR, then the EMPLOYER has agreed that this document constitutes the entire agreement concluded between the parties in relation to the WORKS and the other subject matter hereof, and no warranties, undertakings or representations other than those specifically recorded herein may be relied on by either of the parties.
WHOLE CONTRACT. This contract constitutes the entire Agreement between the parties but it may be amended in writing by mutual agreement of the parties. Such amendment must be ratified by the Senate acting for the Forum and a designated representative of the Board. The proposed amendment shall become part of this document when the parties have exchanged written notification of their formal action.
WHOLE CONTRACT. This Agreement constitutes the entire contract between the PARTIES, and the PARTIES shall not be bound by any representations, terms, conditions, or warranties not contained in this Agreement. The PURCHASER warrants that the PURCHASER was not induced into entering into this contract by any warranty or representation not contained herein.
WHOLE CONTRACT. THIS CONTRACT CONSTITUTES THE COMPLETE AND EXCLUSIVE STATEMENT OF THE CONTRACT BETWEEN THE PARTIES RELEVANT TO THE PURPOSE DESCRIBED HEREIN AND SUPERSEDES ALL PRIOR AGREEMENTS OR PROPOSALS, ORAL OR WRITTEN, AND ALL OTHER COMMUNICATION BETWEEN THE PARTIES RELATING TO THE SUBJECT MATTER OF THIS CONTRACT.

(1) A supplier must not make a transaction or agreement subject to any term or condition if-
(a) its general purpose or effect is to-
(i) defeat the purposes and policy of this Act;
(ii) mislead or deceive the consumer; or
(iii) subject the consumer to fraudulent conduct;
(b) it directly or indirectly purports to-
(i) waive or deprive a consumer of a right in terms of this Act;
(ii) avoid a supplier's obligation or duty in terms of this Act;
(iii) set aside or override the effect of any provision of this Act; or
(iv) authorise the supplier to- (aa) do anything that is unlawful in terms of this Act; or (bb) fail to do anything that is required in terms of this Act;
(c) it purports to-
(i) limit or exempt a supplier of goods or services from liability for any loss directly or indirectly attributable to the gross negligence of the supplier or any person acting for or controlled by the supplier;
(ii) constitute an assumption of risk or liability by the consumer for a loss contemplated in subparagraph (i); or
(iii) impose an obligation on a consumer to pay for damage to, or otherwise assume the risk of handling, any goods displayed by the supplier, except to the extent contemplated in section 18 (1);
(d) it results from an offer prohibited in terms of section 31;
(e) it requires the consumer to enter into a supplementary agreement, or sign a document, prohibited by subsection (2) (a);
WHOLE CONTRACT. This Contract constitutes the whole agreement and understanding of the parties as to the subject matter of this Contract and there are no prior or contemporaneous agreements between the parties.
