Wholesale Pricing. All prices are listed in US dollars. All authorized retailers will receive wholesale trade pricing equivalent to 50% off recommended retail price of our products (“RRP”), plus the cost of shipping. Prices and availability are subject to change without notice. The RRP is the minimum price for which you are permitted to sell our products without our express prior permission in writing. You may sell our products for a price in excess of the RRP, but you are not permitted in any circumstances to sell any products for less than the RRP without our express prior written permission. Wholesale Pricing. Current wholesale pricing can be found on Santosha LLC’s website or by contacting a sales representative from Santosha LLC. This pricing is subject to review and change by Santosha LLC from time to time in its sole and absolute discretion. Santosha LLC does not make any pricing commitments to Authorized Wholesaler.
Wholesale Pricing. ART will from time to time establish its Standard Price List for Service at retail rates ("Retail Pricing"). Purchaser shall pay ART at the Retail Pricing in effect at the time of the Services minus a wholesale discount based on volume purchasing and the length of the term ("Wholesale Pricing"). ART shall have the option to increase or decrease its Retail Pricing at any time and with regard to any Service Area; provided that ART provides notice of such change to Purchaser, in writing and thirty (30) days before the effective date of the price change. The Retail Pricing in effect at the time of the execution of this Agreement are set forth in Attachment D and shall remain in effect for the purposes of this Agreement until further notice. The subsections immediately following set forth the structure of the Retail Rates
Wholesale Pricing. The Network Operator shall establish and publish Price Guidelines setting forth the process and elements of charges for Wholesale Service offered. Network Operator shall provide its initial proposed Price Guidelines within hundred and twenty (120) Days of the Effective Date of the Agreement. Network Operator’s Pricing Guidelines shall be subject to approval by MassTech. The Price Guidelines which shall include applicable price ranges shall be posted on the Network Operator’s website referenced in Section 4.2.
4.10.8.1 The Network Operator and MassTech shall review and update, as appropriate, the Pricing Guidelines on an annual basis.
4.10.8.2 No less frequently than every three (3) years the Network Operator shall conduct a market pricing benchmark analysis reviewing and comparing wholesale broadband pricing trends and practices in markets of comparable size and density, including other markets where the Network Operator or its Affiliates provide services. This analysis shall include pricing and trends regarding non-recurring costs and fees charged to Customers. The Network Operator shall provide the market pricing benchmark analysis to MassTech with recommendations for any changes to the Pricing Guidelines.
4.10.8.3 All Wholesale Services shall be priced and offered in accordance with the Pricing Guidelines and applicable price ranges, provided that such Pricing Guidelines are not intended to act as tariffs or subject the Network Operator or MassTech to Common Carrier regulation. For the avoidance of doubt, the Network Operator shall not file a tariff containing the rates with the Commonwealth of Massachusetts Department of Telecommunications and Cable without the express prior written approval of MassTech.
4.10.8.4 The Parties intend that the Network Operator’s offering of lit Wholesale Services shall be on a private carrier basis.
4.10.8.5 Network Operator shall negotiate in Good Faith with each Wholesale Customer for the provision of Wholesale Services.
4.10.8.6 Network Operator shall not be required to execute substantively identical agreements with all Wholesale Customers. However, material revisions to the form of agreement approved by MassTech shall require MassTech’s prior written approval before being incorporated into agreements to be executed by the Network Operator.
Wholesale Pricing. Purchases made by the cardholder are eligible to purchase our products at wholesale prices.
Wholesale Pricing. Xxx.xxx will provide Agency the applicable discount pricing set forth in the Program Guide, as may be modified by Xxx.xxx from time to time, in its sole discretion (the "Discount") for each order for Services attributed to Agency (each, an "Order"). Agency shall bear all taxes, duties, levies, and other similar charges (and any related interest and penalties), however designated or imposed on it as a result of the existence or operation of the Program, including any income, sales, or use tax on profits which may be levied against it.
Wholesale Pricing. Current wholesale pricing/discounts are visible on Plant Therapy’s website and automatically applied when logged into an approved wholesale account. Wholesale pricing CANNOT be combined with any other “consumer” discounts, promotions, incentives, or offers unless authorized. This pricing is subject to review and change by Plant Therapy from time to time in its sole and absolute discretion. Plant Therapy does not make any pricing commitments to Authorized Wholesaler.
Wholesale Pricing. Company shall cause all third party registrar and reseller agreements that Company enters into to require that such registrars and resellers (the "COMPANY DISTRIBUTORS") use the Registry Technologies for all sales of Recognized Domain Names made during the "XXX.XXX TECHNOLOGY PROVISION PERIOD" (defined as that part of the Term that is not during the Company Technology Provision Period) and make payments thereunder, of all proceeds owed for such sales during the Xxx.xxx Technology Provision Period, directly to Xxx.xxx instead of Company, provided that Xxx.xxx shall then pass through to Company such receipts paid by such Company Distributors during the Xxx.xxx Technology Provision Period, subject to Section 4(c)(iv). If any such parties seek to remit such payments to Company, then Company shall refuse acceptance of such payments and require such parties to remit such payments to Xxx.xxx instead. The parties shall structure all wholesale prices and bounties with registrars and resellers in a manner that shall cause all amounts remitted to (and retained by) Xxx.xxx hereunder to be sufficient to pay Xxx.xxx and Company all fees owed hereunder. Each party shall be liable for failure to pay by any party with whom such party has a registrar or reseller agreement. Neither party shall obligate the other party to make any payments to a third party, and neither party shall represent to a third party that the other party will make any payments thereto.
(i) CO-BRANDED SALES PERIOD. For each sale of a Recognized Domain Name registration or renewal that occurs during the Co-Branded Sales Period, Xxx.xxx shall retain all gross proceeds associated therewith from all sources, but shall pay Company a "CONTRACTUAL WHOLESALE FEE" of $15.00 for such sale, provided that if such sale is for a registration or renewal period of more than one year then such $15 shall be multiplied by the number of days in such registration or renewal period and divided by 365. Xxx.xxx shall pay Company each Contractual Wholesale Fee no later than 30 days after the end of the calendar month during which the sale related to such Contractual Wholesale Fee occurs.
Wholesale Pricing. Worldwide Medical will invoice Cyber Marketing Concepts and Cyber Marketing Concepts will pay the invoice after Worldwide Medical has duly tendered the order to the consumer at the destination specified in the order. Invoicing will include all freight charges borne by Worldwide Medical.
