Wholesale Pricing. Current wholesale pricing/discounts are visible on Plant Therapy’s website and automatically applied when logged into an approved wholesale account. Wholesale pricing CANNOT be combined with any other “consumer” discounts, promotions, incentives, or offers unless authorized. This pricing is subject to review and change by Plant Therapy from time to time in its sole and absolute discretion. Plant Therapy does not make any pricing commitments to Authorized Wholesaler.

Wholesale Pricing. ART will from time to time establish its Standard Pricing for Service as set forth in Sections 11.1.1(B)(2) and (3) below. ART shall have the option to increase or decrease its Pricing at any time and with regard to any Service Area; provided that ART provides Notice of such change to Purchaser thirty (30) days before the effective date of the price change. Reseller shall pay ART at the Standard Pricing in effect at the time of the Services minus a wholesale discount based on volume purchasing and the length of the term ("WHOLESALE PRICING"). Wholesale Pricing. The Network Operator shall establish and publish Price Guidelines setting forth the process and elements of charges for Wholesale Service offered. Network Operator shall provide its initial proposed Price Guidelines within hundred and twenty (120) Days of the Effective Date of the Agreement. Network Operator’s Pricing Guidelines shall be subject to approval by MassTech. The Price Guidelines which shall include applicable price ranges shall be posted on the Network Operator’s website referenced in Section 4.2. 4.10.8.1 The Network Operator and MassTech shall review and update, as appropriate, the Pricing Guidelines on an annual basis. 4.10.8.2 No less frequently than every three (3) years the Network Operator shall conduct a market pricing benchmark analysis reviewing and comparing wholesale broadband pricing trends and practices in markets of comparable size and density, including other markets where the Network Operator or its Affiliates provide services. This analysis shall include pricing and trends regarding non-recurring costs and fees charged to Customers. The Network Operator shall provide the market pricing benchmark analysis to MassTech with recommendations for any changes to the Pricing Guidelines. 4.10.8.3 All Wholesale Services shall be priced and offered in accordance with the Pricing Guidelines and applicable price ranges, provided that such Pricing Guidelines are not intended to act as tariffs or subject the Network Operator or MassTech to Common Carrier regulation. For the avoidance of doubt, the Network Operator shall not file a tariff containing the rates with the Commonwealth of Massachusetts Department of Telecommunications and Cable without the express prior written approval of MassTech. 4.10.8.4 The Parties intend that the Network Operator’s offering of lit Wholesale Services shall be on a private carrier basis. 4.10.8.5 Network Operator shall negotiate in Good Faith with each Wholesale Customer for the provision of Wholesale Services. 4.10.8.6 Network Operator shall not be required to execute substantively identical agreements with all Wholesale Customers. However, material revisions to the form of agreement approved by MassTech shall require MassTech’s prior written approval before being incorporated into agreements to be executed by the Network Operator.

Checks returned due to insufficient funds could be considered fraud and subject the check writer to prosecution and fines. However, we understand that usually there is no criminal intent and in these circumstances, we will only charge the customer a $75 processing fee for bank fees and other incurred costs. Items will not be shipped until full payment is received or a Net30 agreement has been made. No COD orders. We use USPS, FedEx, or UPS Ground shipping, based on cost affordability, unless you specify/request a quicker mode of shipping. On all orders, we include the cost of packaging materials and handling fees in your shipping total. Please inspect all shipments immediately upon arrival. Order errors must be brought to Color Up customer service attention within 5 business days of receipt of shipment. Returned merchandise will be replaced with new merchandise. Returned merchandise will not be accepted if it is held for more than 15 days after receipt. Returned products must be unopened, unused and in its original, saleable condition. Returns due to customer ordering error will be charged a 25% restocking fee. Product that has been tampered with may not be returned. Retail products returned due to customer dissatisfaction will be immediately replaced, but product must be 75% full or no refunds will be given. The returned product must be sent back to Color Up within 30 days of customer receipt with proof of purchase. Back bar items cannot be returned without a valid reason approved by Color Up. Expired products will not be accepted for return. Expiration date of a product is to be determined by Color Up. Return shipping charges may also apply.
