Wilful Misconduct and Gross Negligence. Notwithstanding anything to the contrary in this Agreement, the limitations on liability in this Agreement shall not apply in the case of wilful misconduct (Vorsatz) or gross negligence (xxxxx Fahrlässigkeit) of the Party relying on the limitation.
