Common use of Windfall or Shortfall Clause in Contracts

Windfall or Shortfall. If state funding is inadequate or in excess of the funding necessary to 24 account for the fiscal impact of this agreement, the parties agree to an emergency re-opener to 25 negotiate impact. Articles will be reopened, as appropriate, so that the impact of any windfall or 26 shortfall in District funding may be negotiated and appropriate increases or decreases may be 27 discussed. The parties agree to commence negotiations upon written request of either party to re- 28 open due to a windfall or shortfall.
