Common use of WIP Schedule Clause in Contracts

WIP Schedule. Schedule 3.18 lists the costs and expenses incurred by the Seller or its subsidiaries in connection with all uncompleted existing jobs related to the Garland Business as of the Closing Date, other than jobs between the Seller and its subsidiaries, on the one hand, and the Seller and any of its other subsidiaries, on the other hand (the “WIP Schedule”). The WIP Schedule represents the Seller’s reasonable and good faith estimate of the status of the work performed to date and the results of performance and operations of the Seller for the customers and periods referred to in the WIP Schedule.
