Common use of Wireless Data Usage Clause in Contracts

Wireless Data Usage. The Service contemplates that users’ data consumption rates will be typical/similar to the data consumption rates experienced by services similar to the Services. In the event that Tierra determines that Customer’s data consumption exceeds a reasonable level it shall notify Customer and may, in the exercise of its absolute and sole discretion, suspend Customer’s access to the Service for as long as deemed necessary by Tierra. Tierra reserves the right to charge Customer for overage charges it may incur associated with Customer’s excessive data consumption. Invoices for overage charges shall be paid within 30 days of the date of the subject invoice. Customer shall not be entitled to suspend any payments or to offset any amounts due.
