Common use of WITHHOLDING, SUSPENDING OR REPAYMENT OF GRANT Clause in Contracts

WITHHOLDING, SUSPENDING OR REPAYMENT OF GRANT. 11.1. Without prejudice to the Authority's other rights and remedies, the Authority may withhold or suspend payment of the Grant and/or require the Recipient to repay any Unspent Monies if any of the events set out in clause 34 arise. 11.2. The Recipient agrees and accepts that it may become ineligible for grant support and be required to repay any grant if, in the opinion of HMRC, it engages in tax evasion or aggressive tax avoidance. 11.3. Where all or a proportion of the Grant remains unspent: 11.3.1. at the end of a Financial Year; 11.3.2. at the end of the Funding Period; or 11.3.3. as a result of termination or breach of this Agreement, all or a proportion of the Unspent Monies, as calculated by the Authority, must be repaid to the Authority within 10 Working Days of a written notice for repayment and, in the case of clause 11.3.1, must not be carried forward for use in the following Financial Year without the Authority’s prior written approval. 11.4. Wherever under this Agreement any sum of money is recoverable from or payable by the Recipient (including any sum that the Recipient is liable to pay to the Authority in respect of a Breach of this Agreement), the Authority may unilaterally deduct that sum from any sum then due, or which at any later time may become due to the Recipient under this Agreement or under any other agreement or contract with the Authority.
