Common use of Without limitation of Section 16 Clause in Contracts

Without limitation of Section 16. 9.1 but also without limitation of the NPC’s right to enforce this Agreement, no Program Claimant (including any Enrolled Program Claimant or Qualifying Program Claimant) shall have any right to institute any proceeding, judicial or otherwise, against Merck, the NPC or any Administrator to enforce, or otherwise with respect to, this Agreement.
